In addition to OSHA compliance (discussed above), employers are increasingly paying attention to workplace violence prevention.  Employers seeking to avoid negligent hiring or negligent retention claims must navigate the EEOC’s heightened scrutiny regarding the use of criminal background checks, the ADA’s prohibitions regarding disability discrimination, and laws such as Florida’s “Gun’s at Work Law,” which gives most employees the right to keep their firearm locked in their vehicle in their employer’s parking lot.
